Bankruptcy Exemptions for Suffolk County

Suffolk County is in the higher exemption tier for homestead protection. Under Section 282 of the Debtor and Creditor Law, debtors in Suffolk County can protect up to $204,825 in equity in their primary residence. This is the same tier as the five boroughs, Nassau, Rockland, Westchester, and Putnam counties.

Other New York exemptions include a motor vehicle up to $5,500 above liens and retirement accounts up to $1,711,975 per person. Social Security, veterans' benefits, and unemployment compensation are fully exempt. Personal property like clothing, furniture, a computer, and phone fall under aggregate limits. The Department of Financial Services posts the current amounts. To use state exemptions, the debtor must have lived in New York for 730 days before filing.
